1. About these terms

These terms are the agreement between you and Brandsiro when you browse the site, create an account or buy a domain name. By using the site or placing an order you agree to them. If you do not agree, please do not use the site.

Our refund policy, disclaimer and privacy policy are part of these terms.

2. Who can use Brandsiro

You must be at least 18 and able to enter into a binding contract. If you buy for a company, you confirm that you are allowed to act for it.

You must give accurate details when you register or order, and keep them up to date. We use them to deliver your domain and to contact you about your order.

3. What we do

Brandsiro is a marketplace for domain names. We list names, take payment, hold it in escrow and help move the name from the seller to your registrar account.

We are not a domain registrar. After the transfer, the domain is registered with the registrar you choose, and your relationship with that registrar is governed by its own terms.

4. Listings and prices

Prices are in US dollars. Where the site shows rupees, that is an estimate made at a recent exchange rate so you can compare. Your order is placed and charged in US dollars. Your bank or card issuer may add its own conversion charges.

A name is not yours until your payment is confirmed and the transfer is complete. If two people try to buy the same name, the first confirmed payment gets it. We may correct a wrong price or description, or withdraw a listing, before an order is paid.

Prices do not include renewal fees at your registrar, taxes, or any charges your bank adds.

5. Placing an order

When you place an order and pay, you are making an offer to buy the name at the price shown. The order is accepted when we confirm your payment. We email a receipt with an order number.

We may refuse or cancel an order, for example if the name is no longer available, if we suspect fraud, or if you break these terms. If we cancel a paid order before the transfer starts, you get your payment back in full.

6. Payment, escrow and transfer

Your payment is held in escrow and is not released to the seller until the transfer is done. The steps are:

• The seller is told about your order and starts the transfer.
• We email you the steps for your registrar. You must follow them and give us the details we ask for, such as your registrar account or authorization.
• When the domain is in your registrar account, you confirm it.
• If you do not confirm or raise a problem within 3 days of the transfer being completed, we treat the transfer as accepted and release the payment to the seller.

Most transfers finish within 1 to 3 days, but registrars can add waiting periods that we do not control. Dates we give are estimates.

7. No refunds after purchase

All sales are final. Once you have bought a domain, we do not offer refunds, returns, exchanges or credits. The only exception is when we are unable to complete the transfer to you. The full details are in the refund policy. Please read it before you buy.

8. What you are buying

You are buying the right to the domain name only. You are not buying a website, content, logo, social media accounts, email addresses, a brand, a trademark or any customers or traffic, unless the listing clearly says so in writing.

Logos and pictures shown with a listing are there to show how a name could look, unless the listing says they are included.

Domain names can be similar to names or trademarks that belong to other people. It is your responsibility to check that you are free to use a name for your purpose before you buy it.

9. How you may use the site

You agree not to:

• use the site for anything unlawful, or to buy a name in order to infringe someone else's rights, cybersquat, phish, spam or mislead people;
• give false details, use someone else's payment method without permission, or abuse chargebacks;
• scrape the site in bulk, overload it, or try to get around its security;
• copy or resell our content, listings or design without our written permission.

We may suspend or close an account, and cancel orders, if we reasonably believe these rules have been broken.

10. Your account

You are responsible for keeping your password private and for what happens under your account. Tell us at once if you think someone else has used it. You can buy as a guest, but creating an account lets you see your orders in one place.

11. Selling with us

If you want to list names, contact us. Selling is handled under a separate agreement that sets out commission, payout and seller duties. Nothing on the buyer side of the site makes you a seller.

12. Our content

The site, its design, text and software belong to Brandsiro or its licensors and are protected by law. You may view and use the site for your own purchases. You may not copy it or use our name or logo without our written permission.

13. Limits on our responsibility

Nothing in these terms limits a right you have by law that cannot be limited, or our responsibility for fraud or for death or personal injury caused by negligence.

Subject to that, we provide the site and the names on an as-is basis, as explained in the disclaimer. We are not responsible for lost profit, lost business, lost data or indirect loss. Our total responsibility to you for any claim about an order is limited to the amount you paid for that order.

We are not responsible for delays or failures caused by things outside our control, including registrars, registries, payment providers, internet outages and changes in law.

14. If you cause us a loss

You agree to cover reasonable losses and legal costs that we suffer because you broke these terms, used a domain unlawfully, or infringed someone's rights with a name you bought.

15. Changes

We may update these terms. The date at the top shows when they last changed. A change does not affect an order you have already paid for, which is governed by the terms that applied when you placed it.

16. Governing law

These terms are governed by the laws of India. Disputes that cannot be settled by talking to us first will be dealt with by the courts of India.
